Tree Removal Brown Hill

Brown Hill sits on Ballarat’s eastern edge, where the suburb meets the bush and the old diggings. Two things set tree work here apart from most of the city. Parts of Brown Hill are mapped for bushfire, which changes what you can clear and what clearances your home may need. And the ground has a mining past, which matters once a job involves digging or the lawn starts to sink.

Tree Removal Ballarat wrote this page to cover both, so you know what applies before any work is booked.

Bushfire comes first in Brown Hill

Brown Hill was among the suburbs affected when the Bushfire Management Overlay was expanded around Ballarat, along with Ballarat East and Black Hill. CFA also prepared a township protection plan covering Brown Hill, Nerrina and Invermay. The area met all three of CFA’s high-risk criteria: a fire there could be more intense, it could be well established before it reached homes, and safe road access out is limited.

What applies to your block depends on how it’s mapped:

If your property is… What it means for clearing
In the Bushfire Management Overlay The 10/50 rule may let you clear any vegetation within 10 m of an existing home, and vegetation other than trees within 50 m, without a permit, provided the home meets the conditions. Newer homes may also have a bushfire management plan with set clearances.
In a bushfire-prone area, but not the overlay The 10/30 rule applies instead, with the same 10 m and a 30 m distance.
In neither No bushfire exemption. Native vegetation removal may need a planning permit.

CFA’s standard conditions call for at least 2 m between the lowest branches and the ground near the house, and 4 m of clear height over driveways. Check your address on VicPlan to see which row you’re in. See land clearing and canopy lifting for the details.

Old mining ground

Brown Hill is traditional gold-mining country, and holes do open up. When a large hole appeared at the Brown Hill Reserve, the City of Ballarat said it looked like a sinkhole from an old hole filled in decades earlier. The University of Ballarat’s head of science and engineering disagreed, pointing out it was in a mining area and suggesting an old mine shaft. Black Hill, next door, had a sinkhole open about 50 metres from a primary school in 2020.

The same council officer made a point that’s directly relevant to tree work. Depressions can form where tree stumps were removed and the holes filled with loose soil or wood. So how a stump hole is dealt with matters:

  • grind the stump, or dig it out and backfill and compact properly, rather than tipping in loose fill
  • expect a little settling as old roots rot, and top up with soil
  • if a hole keeps dropping, gets deeper, or opens up underneath, keep clear of it and contact the City of Ballarat rather than filling it again

See stump removal for grinding versus full removal.

Common questions

Can I clear trees around my house in Brown Hill without a permit?

Possibly. If your home is in the Bushfire Management Overlay or a bushfire-prone area and meets the conditions, the 10/50 or 10/30 rules may apply. They don’t override covenants or permit conditions, and they don’t cover clearing for new buildings.

My house was built recently. Do I have to keep certain clearances?

If it was approved under the Bushfire Management Overlay, its planning permit may include a bushfire management plan with set vegetation conditions. Check your permit documents.

The ground has dropped where an old tree used to be. What should I do?

A small stable dip is usually rotting roots or loose fill. Top it up with soil. A hole that keeps sinking or shows a void underneath needs to be reported to council. Brown Hill’s mining history means it shouldn’t be guessed at.

What should I send for a quote?

Photos of the tree, a rough height, what’s nearby (the house, sheds, power lines), whether you know of a bushfire overlay or plan on your property, and any history of sinking ground.
